Copyright Policy

Reporting Claims of Copyright Infringement

Partner Fleet takes copyright infringement claims seriously and will respond to notices complying with applicable law. If you believe materials on https://www.mypartnerfleet.com and/or https://partnerfleet.app infringe your copyright, you may request removal by submitting written notification to the designated copyright agent.

Per the Digital Millennium Copyright Act (17 U.S.C. § 512), your DMCA Notice must include:

  • Your physical or electronic signature
  • Identification of the copyrighted work allegedly infringed
  • Identification of the infringing material with sufficient precision for location
  • Adequate contact information (name, address, phone, email)
  • "A statement that you have a good faith belief that use of the copyrighted material is not authorized"
  • A statement confirming the notice's accuracy
  • "A statement, under penalty of perjury, that you are authorized to act on behalf of the copyright owner"

Failure to comply with all DMCA requirements may render your notice ineffective. Knowingly misrepresenting infringement may result in liability for damages and attorney fees under Section 512(f).

Counter Notification Procedures

If your posted material was removed or disabled by mistake or misidentification, you may file a Counter Notice with the copyright agent. Your Counter Notice must include:

  • Your physical or electronic signature
  • Identification of removed/disabled material and its previous location
  • Adequate contact information
  • "A statement under penalty of perjury...that you have a good faith belief that the material...was removed...as a result of a mistake or misidentification"
  • Statement consenting to federal court jurisdiction

Partner Fleet may restore content if the original complainant doesn't file a court action within ten business days of receiving your Counter Notice. Knowingly misrepresenting removal details may result in damages liability.

Repeat Infringers

"It is our policy in appropriate circumstances to disable and/or terminate the accounts of users who are repeat infringers."
